Terms of Service

1. Acceptance

By accessing or using the TextAlly mobile application (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old or otherwise have the legal capacity to enter into contracts in your jurisdiction to use the Service.

3. Account Information

To use certain features you may provide contact information such as name, email, and phone number. You are responsible for maintaining the accuracy of account information and for keeping any account credentials secure.

4. Use of the Service

The Service is provided to help manage SMS-based appointment booking workflows. You agree to use the Service only for lawful purposes and in accordance with these Terms.

5. User Content

You retain ownership of content you submit (messages, appointment details). By submitting content you grant TextAlly a worldwide, non-exclusive license to use, host, and transmit that content to provide the Service.

6. Payments and Fees

Some features may be offered for a fee. If we introduce paid features, payment terms will be presented at the time of purchase. Refunds, if any, will be handled according to the terms disclosed during purchase.

7. Prohibited Conduct

You must not misuse the Service, interfere with others' use, or attempt to access the Service by means other than the interface provided.

8. Intellectual Property

The Service and its original content (excluding User Content) are owned by TextAlly and protected by applicable intellectual property laws.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, available at privacy.html, which explains how we collect and use personal data.

10. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, TextAlly is not liable for indirect, incidental, or consequential damages.

11. Indemnification

You agree to indemnify and hold TextAlly harmless from any claims arising out of your use of the Service or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which TextAlly is established, unless otherwise required by applicable law.

13. Changes to Terms

We may modify these Terms. Changes will be effective when posted. Continued use after changes constitutes acceptance.
